These terms are an agreement between you and Enterprise Business Systems LLC (“EBS”, “we”, “us”) covering Spartan Operations Center — the website at spartanops.ebsapps.tech and the iOS app (together, the “app”). By creating an account or using the app you agree to them. If you do not agree, do not use the app.

1. Your account

You must be at least 13 years old to use the app. You are responsible for keeping your password confidential and for activity under your account. Tell us at support@EBS.Design if you believe your account has been accessed without your permission. Provide accurate registration information and keep it current.

2. Not medical, dietary, or professional advice

The app is a personal log and planning tool. It is not a medical device and does not provide medical care. Nothing in it diagnoses, treats, cures, or prevents any disease or condition.

• Health values — blood pressure, weight, water, sleep — are whatever you type in. The app does not measure them with any sensor and cannot tell whether a value is correct.
• Calorie, macro, BMR, and TDEE figures are estimates produced by standard population formulas and public food data. They are not a dietary prescription and may be materially wrong for you.
• Workouts, including AI-generated ones, are not written or reviewed by a physician, trainer, or physical therapist, and are not tailored to your injuries, medications, or medical conditions.

Always seek the advice of a qualified health professional with any question about a medical condition, your diet, or an exercise program. Never disregard professional advice or delay seeking it because of something you read in the app. If you think you have a medical emergency, call your doctor or emergency services immediately. You use the app’s health, nutrition, and fitness features at your own risk.

3. AI features

The optional AI assistant and AI workout generator produce output from a language model. That output can be inaccurate, incomplete, outdated, or entirely invented, including dates, numbers, and links. It is not medical, dietary, legal, or financial advice. You are responsible for reviewing AI output before you rely on or act on it. AI features are off until you opt in, and what they send is described in the privacy policy. We may change, limit, or withdraw these features at any time.

4. Your content

You keep ownership of the content you put into the app. You grant us only the limited licence needed to host, process, back up, and display that content in order to operate the service for you. We do not sell your content and do not use your health, fitness, or organizer data for advertising.

You are responsible for the content you enter and for having the right to enter it. Do not use the app to store or transmit anything unlawful, or anyone else’s personal or health information without their permission.

5. Acceptable use

You agree not to:

• Break into, probe, or disrupt the service or anyone else’s account.
• Reverse engineer, decompile, or attempt to extract source code, except where that restriction is prohibited by law.
• Use automated means to scrape the service or place unreasonable load on it.
• Resell or provide the service to third parties, or use it to build a competing product.
• Use the app for any unlawful purpose, or in breach of any applicable export control or sanctions law.

6. Availability and changes

We may change, suspend, or discontinue any part of the app, and we may modify these terms. If we make a material change we will update the date above and show a notice in the app. Continuing to use the app after a change means you accept the revised terms. We do not promise any particular uptime, and the service may be unavailable for maintenance or reasons outside our control.

7. Termination

You may stop using the app and delete your account at any time in Settings → System. We may suspend or terminate your account if you materially breach these terms, or if we discontinue the service. Export your data before deleting your account — deletion cannot be undone. Sections 2, 3, 8, 9, 10, and 11 survive termination.

8. Disclaimer of warranties

The app is provided “as is” and “as available”, without warranty of any kind. To the fullest extent permitted by law, EBS disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the app will be uninterrupted, secure, error-free, or that any data, calculation, or AI output will be accurate or complete. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

9. Limitation of liability

To the fullest extent permitted by law, EBS and its owners, officers, and employees will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or for any personal injury or health consequence arising from your use of or reliance on the app — including reliance on logged values, estimates, or AI output — whether based in contract, tort, negligence, strict liability, or any other theory, and even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to the app or these terms will not exceed the greater of (a) the amount you paid us for the app in the twelve months before the claim, or (b) fifty United States dollars (US$50). Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by our negligence.

10. Indemnity

You agree to indemnify and hold EBS harmless from any claim, damage, loss, or expense (including reasonable legal fees) arising from your content, your use of the app, or your breach of these terms.

11. Governing law

These terms are governed by the laws of the State of Utah, United States, without regard to its conflict of laws rules, and you and EBS submit to the exclusive jurisdiction of the state and federal courts located in Utah. If any provision is held unenforceable, the rest remains in effect. These terms, together with the privacy policy, are the entire agreement between you and EBS regarding the app.

12. Apple App Store

If you obtained the app from the Apple App Store, these terms are between you and EBS only — not Apple — and EBS, not Apple, is solely responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, failure to conform to legal requirements, or consumer protection or privacy claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
